Parking Reservation Agreement & User Consent
PLEASE READ CAREFULLY.
By checking the box below and proceeding with a reservation, you acknowledge that you have read, understand, and agree to the following terms.
- Parking Authorization
Parking is authorized only for vehicles with a valid Spot-A-Park reservation made through the Spot-A-Park website or application.
Any vehicle parked:
Without a valid reservation
Outside the reserved time window
In violation of posted rules or instructions
Is unauthorized and subject to towing at the vehicle owner’s expense. - Towing & Fees
Unauthorized or overstaying vehicles may be towed without notice.
All towing fees, storage fees, administrative fees, and related costs are the sole responsibility of the vehicle owner and/or driver.
Spot-A-Park is not responsible for towing decisions or costs. - Time Enforcement & Overage Charges
Parking reservations are strictly time-based.
Vehicles remaining parked 15 minutes past the reserved hour will be charged for an additional full hour.
Continued overstay may result in towing at the vehicle owner’s expense. - Assumption of Risk
You acknowledge and agree that parking is used entirely at your own risk.
Spot-A-Park is not responsible or liable for:
Theft of a vehicle
Theft of any personal property inside or around a vehicle
Damage to vehicles from any cause, including third parties, weather, vandalism, or accidents. - No Bailment
Use of Spot-A-Park does not create a bailment relationship. Spot-A-Park does not assume possession, custody, or control of any vehicle or its contents. - Right to Refuse Service
Spot-A-Park reserves the right to refuse service to anyone, at any time, for any lawful reason, including violations of these terms, safety concerns, or suspected misuse. - Indemnification
You agree to indemnify, defend, and hold harmless Spot-A-Park, its owners, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:
Your use of the service
Violation of these terms
Any damage, injury, or loss caused by you or your vehicle. - Mandatory Arbitration & Class Action Waiver
PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS
Any dispute or claim arising out of or relating to your use of Spot-A-Park shall be resolved exclusively through binding arbitration, not in court.
You waive your right to participate in a class action, class arbitration, or representative proceeding.
Arbitration shall be conducted in the State of Arizona, under applicable arbitration rules.
Each party shall bear its own costs, except as required by law. - Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.
